The book “Matalib Oli Al-Nuha,” by Al-Rahibani, contains a wealth of jurisprudential rules and regulations, according to the Hanbali school of thought, however, they are scattered throughout the book and need to be collected and studied due to their importance, and this is what was done in this research. The research included: an introduction, a preface, four chapters, a conclusion, and indexes, as follows:
Introduction: In the definition of the author, the book, the definition of rules, jurisprudence controls, and similar terms.
Then the first chapter: On the major jurisprudence rules, and the rules that fall under them. Then the second chapter: On the agreed upon jurisprudence rules, and came in six sections, as follows: The first topic: The rule: the air is subordinate to the decision. The second topic: the rule: the origin is the survival of the king. The third topic: the rule: the judiciary is in the capacity of performance. The fourth topic: a rule: the original and the alternative should not be combined. The fifth topic: the rule: the lottery is the status of judgment. The sixth topic: the rule: borders are repelled by suspicion. Then the third chapter: On the different jurisprudential rules, and it contained one topic, which is: The rule: the exception to the negation is proof. Then the fourth chapter: On the jurisprudential controls, and it contains thirteen topics arranged according to the order of the jurisprudential chapters. The aim of the research: to extract the rules and regulations of jurisprudence in the prescribed part of the book, “Matalib Oli Al-Noha”, and studying them is a scientific study; By explaining their meaning, and their evidence, and the branches that fall under them. Research method: the inductive and analytical approach, where the rules and jurisprudential controls mentioned by the author in the scheduled part of the research were extrapolated. Evidence for it, and the branches that fall under it, and mentions the exceptions, if any.
Among the results of the research: the abundance of jurisprudential rules and controls mentioned in the book: “Matalib Ooli Al-Nuha,” and this indicates Al-Rahibani’s attention to the deductive aspect in his book; Where more than mentioning the transport and mental evidence. Among the recommendations of the research: the continuity of research in the curricula of imams of jurisprudence and fatwas, from Muslim scholars, and to show the rules and regulations of jurisprudence they have in their books, through scientific messages. |
